Welcome to DoodleTale (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, iOS mobile application, and related services (collectively, the “Services”). By accessing, downloading, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
We may update these Terms periodically. Any changes will be posted on this page with a new effective date. Your continued use of the Services after such updates constitutes acceptance of the revised Terms.
1. Eligibility
You must be at least 18 years old or have a parent/guardian’s consent to use DoodleTale. If you are a parent or guardian, you are responsible for your child’s use of the Services.
2. Our Services
DoodleTale allows children and their parents to upload drawings, submit forms, and generate AI-assisted stories through our website and iOS app.
We may update, change, or remove features at any time without notice.
3. Accounts and Form Submissions
Some features may require you to submit personal information (such as your name, email address, and other details) via an online form or by creating an account.
You agree to:
Provide accurate and complete information.
Keep your login credentials (if applicable) secure.
Notify us immediately if you suspect unauthorized access.
Understand and consent that your collected and submitted data will be processed in accordance with our Privacy Policy.
4. Content You Submit
By submitting drawings, text, or other materials (“User Content”), you:
Confirm you own the rights or have permission to share the content, and that such content does not infringe any third party intellectual property rights.
Grant us a non-exclusive, worldwide, royalty-free license to use, display, and adapt, and incorporate your User Content into AI training and output generation for providing and improving our Services.
Understand that AI-generated content may be unpredictable and is provided “as is.”
5. Acceptable Use
Our services are designed primarily for your personal, non-commercial enjoyment. Please keep in mind that your use of the Services is at your own risk, including if you choose to use our services with commercial purpose. We encourage all users to use the Services responsibly and with care.
You agree not to:
Upload or submit anything unlawful, harmful, offensive, harassing, abusive, defamatory, libelous, slanderous, obscene, profane or inappropriate for children.
Use or promote any discriminatory, hateful, or harassing content based on race, gender, religion, nationality, disability, sexual orientation, or any other protected status.
Include any depiction or description of blood, gore, violence, or other graphic imagery.
Link to or reference material that could be interpreted as libelous, obscene, criminal, or advocating illegal activity.
Attempt to hack, disrupt, or reverse engineer our Services.
Misuse AI outputs in ways that could cause harm.
6. Intellectual Property
All DoodleTale branding, designs, content on our Website or iOS App, and technology, including, but not limited to, text, graphics, logos, images, source code, databases, software, and functionality are owned by us or our licensors. You may not copy, distribute, modify our intellectual property or create derivative works without our prior express written permission.
If you use our free services, the content you generate may be used, displayed, distributed, and commercialized both on and off the platform by DoodleTale, other users or third-parties worldwide under a royalty-free, sublicensable license. You retain a global, non-exclusive, royalty-free license to use your generated content for personal purposes.
If you use our paid services, you retain full ownership of all content you generate, for as long as your paid subscription remains active. While your paid subscription is active, any content you create is private by default and will only be accessed by DoodleTale as needed to provide and improve our Services. You may choose to make this content public at any time and share it in the Community Library. By making your content public or sharing it within or outside the platform, you grant DoodleTale a worldwide, royalty-free, non-exclusive, sublicensable license to display, distribute, adapt, and use your content for service enhancement, promotion, marketing, and related purposes, including on social media platforms. DoodleTale will not claim authorship or ownership of your content.
If your paid subscription ends or is downgraded to a free account, all content generated during your paid subscription, including any content that you previously kept private, will immediately become subject to the terms and licenses applicable to free accounts. This means DoodleTale and other users or third-parties may use, commercialize, display, and distribute such content both on and off the platform, and you will no longer have exclusive or private rights to that content. DoodleTale is not responsible for any loss of exclusivity, commercial value, or third-party use of your content after your status changes to a free account.
Maintaining exclusivity, privacy, or brand value is entirely your responsibility. DoodleTale is not responsible for any loss of exclusivity, commercial value, or third-party use of your content at any time, whether you have a paid subscription or a free account. You are fully responsible for ensuring that your content, as well as any AI-generated content you publish or use for personal or commercial purposes, complies with all applicable laws, including third-party intellectual property rights, and you accept the full disclaimers, including AI content accuracy, originality, IP infringement and suitability as set forth in Sections 7 and 10.
7. AI-Generated Content Disclaimer
AI-generated stories and outputs may contain unexpected results, inaccuracies, unintended bias, or inappropriate content despite measures taken to minimize such risks. We make no guarantees about accuracy, appropriateness, fitness for a particular purpose or the uniqueness or originality of AI-generated content (such content may resemble creations from other users, and similar or identical outputs might be produced for different users). You are responsible for evaluating the accuracy, suitability, and appropriateness of all AI-generated content. Parental supervision is strongly advised.
8. Subscription, Billing, and Payment Terms
When you subscribe to our monthly plan, your payment will be automatically billed every month until you decide to cancel. You can cancel your subscription anytime through your account settings, with the cancellation taking effect from the following billing cycle. For annual subscriptions, payment will be charged once per year. Your subscription will continue to renew automatically on the selected plan until you cancel. By subscribing, you agree that we may charge your payment method on a recurring basis without needing further approval for each charge until you cancel your subscription.
Please note that all subscription payments, whether monthly or yearly, are non-refundable—even if you cancel before the end of your current billing period.
Payments must be completed through our authorized third-party payment processors at the time of order. You will be asked to provide your payment information directly to these providers and may be required to agree to their terms of service. We do not assume any liability for issues arising from your use of these third-party payment services beyond what is permitted by applicable law.
You confirm that all payment details you provide are accurate, that the payment method belongs to you, and that you have sufficient funds or credit available to cover your subscription charges.
Accepted payment methods include: Visa, Mastercard, Apple Pay, Google Pay.
9. Privacy
Your privacy is important to us. Please see our Privacy Policy for how we collect, store, and protect the information you submit through forms or other means, including special provisions for children’s data and parental consent under COPPA, GDPR, and other applicable laws.
10. Termination
We may suspend or terminate your access if you violate these Terms or use the Services inappropriately. We reserve the right to moderate, filter, or remove any User Content or AI-generated output that we determine to be harmful, inappropriate, or in violation of these Terms or applicable law.
11. Disclaimers & Limitation of Liability. Indemnity. Governing Law and Dispute Resolution
Our Services are provided “as is” for your personal, non-commercial use, without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Services, including but not limited to those arising from copyright infringement, trademark violations, or other intellectual property disputes related to your user-submitted content or AI-generated outputs. You agree to indemnify and hold harmless DoodleTale from any such claims or legal actions resulting from your use of the Services.
These Terms are governed by and construed under the laws of Estonia, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the use of Services shall be resolved exclusively in the courts of Tallin, Estonia.
